Terms of Service

These Terms of Service govern access to and use of Vuka, a DigitalFWD company, including the Vuka website, user accounts, provider profiles, quotation tools and related marketplace services. By creating an account, accessing the platform or using Vuka, you agree to these Terms.
1. About Vuka
Vuka is a digital services marketplace that helps customers discover and connect with independent service providers and businesses. Customers can browse services, view provider profiles and request quotations. Providers can create profiles, list services, showcase previous work and respond to customer enquiries.
2. Eligibility and accounts
You must be legally capable of entering into the transactions you undertake through Vuka. You agree to provide accurate, current and complete information and to keep your account information up to date. You are responsible for safeguarding your password and for activity carried out through your account.
You may not create an account using false information, impersonate another person or business, or use another user's account without permission.
3. Customer accounts
Customers may use Vuka to search for services, view provider profiles and submit quote requests. A quote request is an invitation for providers to respond and does not itself create a contract or guarantee that a provider will accept the work.
Customers are responsible for reviewing provider information, quotations, scope, timing, pricing and any other terms before appointing a provider.
4. Service provider accounts
Providers may register as an Individual or Business. Providers are responsible for ensuring that their profile, services, qualifications, experience, pricing indications, availability, business details and portfolio content are accurate and not misleading.
Where a service requires a licence, permit, registration, qualification or other legal authorisation, the provider is responsible for ensuring that it holds the required authorisation before offering or performing that service.
5. Vuka's marketplace role
Unless Vuka expressly states otherwise for a particular service, Vuka provides the technology platform through which customers and independent providers can find and communicate with each other. Vuka is not the provider of services advertised by third-party providers and is not automatically a party to an agreement concluded between a customer and a provider.
Vuka does not guarantee that a customer will receive quotations, that a provider will receive work, or that any user will complete a transaction.
6. Quotations, appointments and payment
Providers are responsible for the content and accuracy of quotations they submit. Customers should confirm the scope of work, deliverables, pricing, payment terms, timing, materials, warranties and any other important terms directly with the chosen provider.
Unless a Vuka payment feature expressly states otherwise, payments arranged directly between customers and providers are made at their own discretion and risk.
7. Profiles, verification and trust information
Vuka may provide profile-completion indicators, email verification, identity or business verification features, ratings, reviews or other trust signals. These features are intended to help users make informed decisions but are not guarantees of identity, licensing, workmanship, reliability, safety or future performance.
8. Reviews and user content
Reviews must relate to genuine experiences and must not be fraudulent, defamatory, abusive, discriminatory or intentionally misleading. Vuka may remove reviews or other content that violates these Terms or applicable law.
9. Photos, logos and portfolio content
When you upload a profile image, business logo, header image, portfolio item, attachment or other content, you confirm that you own the content or have permission to use it. You grant Vuka a non-exclusive licence to host, store, reproduce and display that content as reasonably necessary to operate and promote the marketplace.
10. Featured and sponsored providers
Vuka may offer paid Featured or Sponsored placement. Sponsored placement may affect where a provider appears in search or category results. Paid placement does not constitute a guarantee, certification or endorsement of the provider or its services.
11. Acceptable use
You may not use Vuka to commit fraud, submit fake requests, harass or threaten others, publish unlawful or infringing content, distribute malicious software, interfere with platform security, scrape or harvest data without authorisation, manipulate reviews or rankings, or use the platform for any unlawful purpose.
12. Safety and transactions between users
Users should exercise reasonable care when meeting, appointing or working with people first contacted through Vuka. Where appropriate, confirm identity, qualifications, licences, references, scope of work and payment arrangements before work begins.
13. Suspension and termination
Vuka may restrict, suspend or terminate access to an account, listing or feature where we reasonably believe this is necessary to protect users, investigate suspected fraud or misuse, enforce these Terms, comply with law, protect the platform or respond to security risks.
14. Intellectual property
The Vuka name, branding, platform design, software, databases and original content are owned by or licensed to Vuka and DigitalFWD. Except as permitted by law or with written permission, users may not copy, reproduce, modify or exploit these materials.
15. Availability and changes to the service
We aim to keep Vuka available and useful, but we do not guarantee uninterrupted or error-free operation. We may update, improve, suspend or discontinue features where reasonably necessary, including for maintenance, security, legal or operational reasons.
16. Limitation of liability
To the fullest extent permitted by applicable law, Vuka and DigitalFWD are not responsible for the acts or omissions of independent customers or service providers, or for the quality, safety, legality, pricing, timing or outcome of services arranged between users. Nothing in these Terms excludes liability that cannot lawfully be excluded.
17. Indemnity
To the extent permitted by law, you agree to be responsible for losses, claims or costs arising from your unlawful use of Vuka, your breach of these Terms, or content you upload that infringes another person's rights.
18. Governing law
These Terms are governed by the applicable laws of the Kingdom of Eswatini. Any dispute that cannot be resolved directly will be subject to the jurisdiction of the competent courts of Eswatini, unless applicable law requires otherwise.
19. Changes to these Terms
We may update these Terms when the platform, legal requirements or our services change. The current version will be published on Vuka with an updated revision date. Continued use of Vuka after an updated version takes effect constitutes acceptance of the revised Terms where permitted by law.
